WHAT TO EXPECT FROM THIS PROGRAM Legal Council Seller has the right and has been advised to seek legal council regarding any and all documents regarding the listing and sale of said property. Any contradicting comments and or terms in the statement supersede the listing contract. This is a limited service listing agreement. Listing Broker and or listing agent are acting as a Seller's Agent with limited services only. The property will be listed on the Multiple Listing System as well as any other sites that may be associated sites. --------------------------------------------------------------------------------------------------------------------------------------------------- Start Up Fees All fees paid in advance are non refundable. Payment can be paid when the documents are completed and returned. --------------------------------------------------------------------------------------------------------------------------------------------------- Agent completed documents (Optional) If you require the documents to be completed for you prior to you receiving them an additional fee of $50.00 will apply. If you choose this option, all fees must be paid in advance. --------------------------------------------------------------------------------------------------------------------------------------------------- Length Of Listing If seller chooses to list for 12 months and the property sells in less than that amount of time, no money will refunded for the difference. Also, if the seller enters into a contract to sell and the sale fall through, the contract dates on the listing contract will remain the same. (No credit will be given for time off the market during a pending sale) --------------------------------------------------------------------------------------------------------------------------------------------------- Property Showings All showings will be arranged and scheduled directly through seller. Any feedback, follow up or results of said showings are to be seller’s responsibility. Seller must also provide a phone number for other Agents/Brokers to contact them regarding showings. --------------------------------------------------------------------------------------------------------------------------------------------------- Property Photos You may provide up to 24 photos to post on the MLS at time of listing. These photos can either be e-mailed or supplied on a CD in JPEG format ONLY. (No Floppy Disk or Printed Photos Will Be Accepted). All pictures must be renamed with numbers only in the order that you would like them uploaded. (For example 1front, 2living room...) Be sure that when you rename the pictures that the number is in front of the name. The front photo must always be the first photo. Seller understands once the property is listed on the MLS, it may take up to 48 hours for all the photos to be displayed on the MLS. Any photo changes or photo additions once the property is listed on the MLS a fee of $5.00 will be charged per photo. --------------------------------------------------------------------------------------------------------------------------------------------------- Limited Service Agreement Listing Agent/Broker is working as a Seller's Agent with limited service. Normally no council or legal advice will be given to seller during the listing period. Seller understands that this program is a "For Sale By Owner MLS Only Program". Seller also understands that the listing agent does not normally visit the property or meet with seller to execute the paperwork. --------------------------------------------------------------------------------------------------------------------------------------------------- Returning the listing documents All paperwork will be delivered to seller via the Internet. To return the listing documents you may scan and e-mail them to dougybaird@aol.com, fax the documents to 616-588-6311 or mail them to me at 1525 Penncross Dr. SE Caledonia, MI 49316. If you choose to mail the document be sure you enclose them in an envelope large enough so that the documents are not folded. --------------------------------------------------------------------------------------------------------------------------------------------------- Offers To Purchase All offers submitted by Agents/Brokers are to be presented directly to the property owner. Any and all completed offers must be provided to listing company. Seller agrees to advertise the property with the address or said property. No references are to be made regarding that the home is listed on the MLS in said advertisement. The MLS number is not to be mentioned and the Broker’s name, phone number and address is to be excluded from the ad. The listing Broker does reserve the right to advertise and market the property as seen fit with out consent from the seller at listing Brokers expense. Any deviation from this agreement may result in the listing being withdrawn from the market. -------------------------------------------------------------------------------------------------------------------------------------------------- Corrections, Updates or Changes Once the home has been posted on the MLS, the listing agent will E-mail the MLS number to the seller. Any and all corrections made with in the first 7 days of the listing are free. All changes, corrections, changes or updates made after the 3rd day of the original listing date are to be at seller’s expense. ($5.00 per change) --------------------------------------------------------------------------------------------------------------------------------------------------- Listing Price Seller is responsible for choosing the list price. If seller requires a price reduction, a $5.00 fee will apply for each reduction and must be paid in advance. If seller wishes the Listing Agent/Listing Broker to provide a CMA (Competitive Market Analysis) once the home is listed a cost of $100.00 must be paid to Listing Agent/Listing Broker in advance. Said CMA will be provided to seller with in seven days of receipt of cleared payment. All price reductions must be submitted through listing agent and or Listing Broker and in writing on proper MLS forms. These forms will be provided my listing office at no cost. --------------------------------------------------------------------------------------------------------------------------------------------------- Referring Buyers To Listing Agent/Broker The standard MLS listing contracts requires the seller to refer all inquires to this listing Broker/Agent. This is waived under this contract If seller produces there own buyer. Seller has the right to enter into a contract with a buyer that is not working with a licensed Agent/Broker and will not be responsible for any fees, commissions. Seller has the right to sell the property on their own to their own buyer and avoid paying any additional Brokerage Fees to a Selling Broker. Seller has been advised to avoid trying to “by pass” a Selling/Broker if said buyer is currently working with an Agent/Broker under a buyer agency contract. Doing so may result in paying a commission later if the selling Agent/Broker pursues a commission in a Court Of Law. --------------------------------------------------------------------------------------------------------------------------------------------------- Seller Agrees To Complete All Listing Documents A listing contract, seller’s disclosure, lead base paint disclosure, agency disclosure, limited service addendum and Grand Rapids Realty For Sale By Owner MLS only limited service agreement. --------------------------------------------------------------------------------------------------------------------------------------------------- Completed Offers To Purchase Seller agrees to provide a copy of any and all fully executed purchase agreements of the listed property. Seller is also responsible to notify the title company to e-mail the listing agent of all closing doc pertaining to the sale. --------------------------------------------------------------------------------------------------------------------------------------------------- Moneys and Fees Paid In Advance Payment can be made one of two ways. Seller may pay via personal check. Checks are to be made out to Grand Rapids Realty. Seller may also pay via Pay Pal to the e-mail address of dougybaird@aol.com. Checks written buy seller and accepted by Broker/Agent with insufficient funds to cover said check will result in a $100.00 penalty to be paid by seller to broker by means of a money order or certified funds. If seller fails to provide said funds, the broker reserves the right to withdraw the property from the MLS and the terms and dates of the listing contract will be in full force subsequently preventing the seller from selling property unless the entire brokerage fee as well and any penalties are paid in full. --------------------------------------------------------------------------------------------------------------------------------------------------- Seller May Expire The Home From The Market At any time the seller may remove the home from the market at any time. The fee for this service is $5.00. --------------------------------------------------------------------------------------------------------------------------------------------------- Sale Falls Through If seller enters into a sales contract and the sale does not result in a closing and the listing status must be changed from pending to current. Their is no fee for this change in status. --------------------------------------------------------------------------------------------------------------------------------------------------- Listing Comments It is the seller’s responsibility to provide the listing comments to the listing broker in a “Word, Works, or Note Pad” format. No hand written comments will be accepted. Most MLS systems allow for up to 500 characters maximum. Some additional verbiage may be added to the listing card to eliminate renter and rent to own inquiries. It will also encourage buyers to drive by the property before making inquiries so that they may call the number you have on your sign. The listing remarks can be e-mailed or saved to a CD along with the photos. --------------------------------------------------------------------------------------------------------------------------------------------------- Property is Sold By Listing Agent/Broker Any offers written by listing Agent/Broker and accepted by the property owner/seller the agreed commission on the listing contract to selling Agent/Broker is to be paid. Seller also understands that if this occurs, the Brokerage may become a dual agent. Seller also understand that the listing agent may receive calls on the listed property and may convert said call into a viable buyer for the property and is excepted to be paid the agreed commission in the listing agreement. This agreement excludes any offers the seller hires the listing agent to write for seller and seller's buyer in such a case the seller find their own buyer. Calls and inquiries on seller's property taken by the listing Agent and or Broker will not be referred to the seller. --------------------------------------------------------------------------------------------------------------------------------------------------- Seller's Phone Number Seller understands that the Real Estate Board does not allow the seller's number to appear on the listing card in such a place that is visible to the public. The seller's phone number will be visible to agents with access to the MLS your property is listed on for the purpose of scheduling showings and presenting offers. --------------------------------------------------------------------------------------------------------------------------------------------------- Re-Listing The Property Once you have signed up for this program, it can not be extended nor can any moneys paid be used towards another programs offered by this organization. Once your contract expires, you will need to start the process from the beginning in order to re-list your property |
